1. Introduction

Welcome to Body Revive Medspa.

These Terms of Service (“Terms”) govern your access to and use of our website at https://bodyrevive.ca, our online store, appointment booking services, products, treatments, and related services.

In these Terms, “Body Revive Medspa,” “we,” “us,” and “our” refer to Body Revive Medspa, located at 1100 Sheppard Avenue East, Suite 205, North York, Ontario, Canada. “You” and “your” refer to any person who visits our website, purchases our products, books an appointment, or receives our services.

Our online store is powered by Shopify. We use Jane App for appointment scheduling, client management, and electronic medical records (EMR).

By accessing our website, making a purchase, or booking an appointment, you acknowledge that you have had the opportunity to review these Terms and agree to the provisions applicable to your transaction or use of our services. Additional treatment-specific consent forms, booking conditions, or product terms may also apply.

If you do not agree with these Terms, please do not use our website or services.

2. Eligibility and Acceptable Use

You agree to use our website, products, and services only for lawful purposes and in accordance with these Terms.

You must provide accurate and complete information when making a purchase, booking an appointment, or completing any required forms.

You must not use our website or services to engage in fraudulent activity, interfere with website operations, compromise security, submit misleading information, or violate the rights of others.

Certain treatments and services may be subject to age restrictions, medical suitability requirements, practitioner assessments, or additional consent requirements.

We reserve the right to refuse, modify, postpone, or discontinue a service where reasonably necessary for safety, eligibility, legal compliance, or other legitimate reasons.

3. Medical Spa Services and Treatments

Body Revive Medspa offers medical/aesthetic and non-medical spa and beauty treatments, subject to availability and the qualifications and scope of practice of the relevant practitioner.

Treatment availability, suitability, and delivery may depend on your health history, consultation, treatment goals, and other relevant factors.

Before certain treatments, you may be required to complete medical history forms, consultation forms, informed consent documents, or other assessments.

You agree to provide accurate and complete information relevant to your treatment, including information about medical conditions, allergies, medications, previous procedures, and other factors that may affect treatment suitability or safety.

We may decline, modify, postpone, or discontinue a treatment if proceeding may be inappropriate or unsafe.

Nothing on our website guarantees that a particular treatment is suitable for every individual. Website descriptions are for general informational purposes and do not replace an individualized consultation or professional assessment.

4. Treatment Results and Expectations

Individual treatment outcomes vary. Results may depend on individual characteristics, health history, treatment type, adherence to aftercare instructions, and other factors.

Photographs, testimonials, descriptions, and examples displayed on our website or social media are provided for informational or illustrative purposes. They do not guarantee that you will achieve the same or similar results.

Unless expressly stated in a separate written agreement, Body Revive Medspa does not guarantee a particular aesthetic or treatment outcome.

If you experience unexpected symptoms or concerns following a treatment, contact the clinic or an appropriate healthcare professional. Seek urgent medical attention when symptoms indicate a medical emergency.

Nothing in these Terms excludes any professional duty or legal obligation applicable to the services provided.

5. Appointments and Booking

Appointments may be booked through Jane App, our website, or other booking methods made available by Body Revive Medspa.

When booking an appointment, you are responsible for providing accurate contact information and selecting the appropriate service.

Appointment availability may change, and a booking is subject to confirmation.

Please arrive on time and follow any preparation instructions provided before your appointment. Arriving late may affect the time available for your treatment and may require the appointment to be shortened or rescheduled, depending on the circumstances.

We reserve the right to reschedule or cancel appointments when reasonably necessary, including due to practitioner availability, operational issues, safety concerns, or circumstances beyond our control. Where we need to change an appointment, we will make reasonable efforts to notify you and arrange an alternative where appropriate.

If we cannot provide a booked service, any rescheduling, credit, or refund will be handled according to the circumstances, the applicable booking terms, and legal requirements.

6. Appointment Cancellation and Rescheduling Policy

Body Revive Medspa requires a minimum of 24 hours' notice for appointment cancellations and rescheduling requests.

6.1 Cancellations or Changes Made at Least 24 Hours in Advance

Appointments may be cancelled or rescheduled without a late-cancellation penalty when at least 24 hours' notice is provided.

Cancelling an appointment does not automatically entitle you to a refund for a service, product, or package already purchased.

6.2 Late Cancellations

Cancellations or rescheduling requests made less than 24 hours before the scheduled appointment will result in the forfeiture of the applicable deposit, where one has been paid and forfeiture is legally permitted.

For appointments booked using prepaid treatment packages, the full prepaid session will be forfeited.

For individually paid appointments, the full session price may be charged in accordance with the booking terms disclosed before the appointment is confirmed.

Any deposit already collected will be applied toward the applicable cancellation charge rather than charged a second time for the same amount.

6.3 Missed Appointments

Failure to attend a scheduled appointment without providing the required notice will be treated as a no-show.

For prepaid treatment packages, the full session will be forfeited. For individually paid appointments, the full session price may be charged in accordance with the applicable booking terms.

6.4 Prepaid Package Sessions

A session forfeited because of a late cancellation or no-show will be deducted from the remaining balance of the applicable prepaid package.

Forfeited sessions cannot be reinstated or transferred to another appointment, except where required by applicable law or otherwise agreed by Body Revive Medspa.

By booking an appointment or purchasing a treatment package, you acknowledge that this cancellation policy applies to your booking.

7. No Refund Policy

All sales are final. Services and products are non-refundable, except where a refund or other remedy is required by applicable law.

All purchases from Body Revive Medspa are subject to our No Refund Policy.

This includes, but is not limited to:

• Medical/aesthetic and non-medical spa services.
• Skincare, beauty, and other products sold through our online store.
• Prepaid treatment packages and service bundles.
• Prepaid sessions and promotional offers.
• Gift cards and gift certificates, subject to applicable legal requirements.

Dissatisfaction with treatment results, changes in personal circumstances, or a change of mind does not automatically entitle a customer to a refund.

Cancelling or rescheduling an appointment in accordance with our 24-hour policy does not, by itself, create a right to a refund for a completed purchase.

Nothing in this policy excludes rights or remedies that cannot legally be waived.

8. Prepaid Packages, Sessions, Gift Cards, and Expiry

8.1 Prepaid Treatment Packages and Sessions

Prepaid treatment packages and sessions are subject to the terms disclosed at the time of purchase.

Where legally permitted, prepaid treatment packages and sessions expire one year after the date of purchase. Any applicable expiry date will be communicated at the time of purchase.

Unused sessions remaining after the applicable expiry date may no longer be redeemable, except where applicable law requires otherwise.

Sessions forfeited because of late cancellations or no-shows remain subject to the cancellation policy in Section 6.

8.2 Gift Cards and Gift Certificates

Gift cards and gift certificates are subject to the conditions disclosed at the time of purchase and applicable Ontario law.

A gift certificate limited to one specific service may be subject to different expiry rules from a monetary-value gift card redeemable toward a range of goods or services.

Where an expiry date is legally permitted, the gift certificate will expire one year after the date of purchase, as disclosed at the time of purchase. Where applicable law prohibits expiry, the gift card or remaining balance will remain valid as required by law.

Gift cards and gift certificates are non-refundable and are not redeemable for cash except where required by applicable law.

8.3 Promotional Offers

Promotional offers, discounts, and complimentary benefits may have specific eligibility requirements, restrictions, and expiry dates disclosed when offered.

Promotional benefits may expire after one year or on an earlier stated date where legally permitted and clearly disclosed.

8.4 Package and Gift Card Conditions

Clients are responsible for reviewing the terms, included services, expiry information, and restrictions applicable to a package or gift card before purchasing.

Expiry provisions do not override mandatory consumer rights or other legal obligations.

9. Products and Online Purchases

Products are offered for purchase through our online store, subject to availability.

We make reasonable efforts to ensure that product descriptions, photographs, prices, and other information displayed on our website are accurate.

Product colours, packaging, and appearance may vary from the images shown online. Product availability may change without notice.

We reserve the right to correct errors, update product information, limit quantities, or discontinue products where appropriate.

Submitting an order does not guarantee acceptance. We may decline or cancel an order where there is a legitimate reason, including suspected fraud, pricing errors, inventory issues, or other circumstances that prevent us from fulfilling the order.

If payment has been collected for an order that we cancel, any applicable refund will be handled in accordance with applicable law.

All product purchases are final and non-refundable, except where a refund or other remedy is legally required.

You are responsible for reviewing product ingredients, instructions, warnings, and suitability before use. If you have allergies, sensitivities, or other concerns, consult an appropriate healthcare professional before using a product.

10. Pricing, Payments, and Deposits

Prices are displayed in the currency indicated on our website and may change without prior notice, subject to applicable law and any confirmed purchase.

Applicable taxes, shipping charges, and other disclosed fees may be added to the purchase price.

Online transactions may be processed through Shopify and the payment services made available through our online store.

You authorize the applicable payment provider to process charges associated with your order or booking.

Deposits or advance payments may be required for certain appointments or services. The amount, payment timing, and applicable cancellation conditions will be disclosed before you confirm the booking.

Deposits are applied toward the relevant purchase or service. If an appointment is cancelled late or missed, a deposit may be forfeited in accordance with Section 6 and applicable law.

11. Treatment Suitability and When a Treatment Cannot Proceed

Treatment suitability may be assessed during a consultation or at the scheduled appointment.

If a practitioner determines that a treatment cannot safely or appropriately proceed, Body Revive Medspa will consider the circumstances and applicable booking terms to determine whether rescheduling, a credit, a refund, or another appropriate resolution is available.

The outcome may depend on the reason the treatment cannot proceed, the nature of the service, any applicable deposit or package terms, and the legal obligations that apply.

No provision of these Terms requires a practitioner to perform a treatment that they reasonably consider unsafe or inappropriate.

Nothing in this section limits any refund or other remedy required by law.

12. Client Information, Medical Records, and Consent

You may be required to provide personal information, medical history, consultation responses, treatment consent, and other information relevant to your care.

We use Jane App for appointment scheduling, client management, and electronic medical records.

You agree to provide truthful and complete information relevant to your treatment and to notify the appropriate practitioner of material changes to your health information where relevant to treatment safety.

You are responsible for reviewing applicable consent forms and asking questions about a proposed treatment before proceeding.

Your personal information and medical records are handled in accordance with our Privacy Policy and applicable privacy laws, including Ontario's Personal Health Information Protection Act, 2004 (PHIPA), where applicable.

Accepting these Terms does not replace any specific consent required for the collection, use, or disclosure of personal health information.

13. Before-and-After Photographs and Marketing Consent

Photographs may be taken where appropriate for consultation, treatment planning, documentation, or monitoring treatment progress.

The use of identifiable client photographs for marketing, social media, website galleries, or promotional materials requires separate consent or other legal authority where required by law.

Agreeing to receive a treatment or allowing photographs to be taken for treatment documentation does not automatically authorize promotional use.

Clients may ask questions about how photographs will be used before providing consent. Any withdrawal of consent will be handled in accordance with applicable law and the terms of the applicable consent.

14. Minors and Consent

Certain services may be subject to minimum age requirements, legal restrictions, or additional consent requirements.

Where a client is under 18 years of age, the availability of treatment and any required parental, guardian, or substitute decision-maker involvement will depend on the nature of the service and applicable law.

Age alone does not determine who may legally consent to every treatment or disclosure of personal health information.

Body Revive Medspa may request proof of age, additional documentation, or authorization where reasonably necessary to establish eligibility or comply with applicable requirements.

We reserve the right to decline a booking or treatment where eligibility or consent requirements have not been satisfied.

15. Website Content and Intellectual Property

Unless otherwise indicated, the content on our website, including text, photographs, graphics, logos, designs, and other materials, belongs to Body Revive Medspa or is used with permission.

You may access and use our website for personal, non-commercial purposes.

You may not reproduce, distribute, modify, republish, sell, or commercially exploit our website content without prior written permission, except where permitted by law.

All trademarks, logos, and other identifying marks displayed on our website remain the property of their respective owners.

16. Reviews, Feedback, and Submissions

If you submit a review, comment, suggestion, or other content to us, you confirm that it is truthful to the best of your knowledge and does not unlawfully infringe another person's rights.

You must not submit unlawful, fraudulent, threatening, defamatory, or misleading content.

Where you voluntarily submit feedback for our consideration, you authorize us to use that feedback to improve our services, subject to applicable law and any privacy or confidentiality obligations.

We will not treat a treatment record, private medical communication, or confidential client photograph as a public testimonial or promotional submission merely because it was provided to us for treatment purposes.

Our website and booking process may contain links to or integrations with third-party services, including Shopify and Jane App.

Third-party services operate under their own terms, privacy policies, and service arrangements.

We are not responsible for the content or practices of third-party websites that we do not control. Your use of those services may be subject to additional terms imposed by the relevant provider.

We aim to keep our website and online services available and functioning properly. However, we do not guarantee uninterrupted access or that every feature will always be available without error.

Website content may occasionally contain typographical errors, inaccuracies, omissions, or outdated information.

We reserve the right to correct errors, update content, suspend features, or modify website functionality when necessary.

Nothing in this section limits obligations that apply to confirmed purchases or services under applicable law.

To the extent permitted by applicable law, Body Revive Medspa will not be responsible for losses arising from circumstances beyond our reasonable control, interruptions to third-party services, or unauthorized conduct by third parties.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, including applicable professional duties, mandatory consumer rights, or liability that cannot legally be excluded.

These Terms do not replace informed consent, treatment-specific disclosures, professional standards, or obligations applicable to a service.

20. Indemnification

To the extent permitted by law, you are responsible for losses or reasonable costs arising directly from your unlawful use of our website, fraud, or intentional violation of these Terms or the rights of another person.

Nothing in this section requires you to indemnify Body Revive Medspa for our own negligence, misconduct, or obligations where such indemnification would be prohibited by applicable law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any invalid or unenforceable provision will be interpreted or limited only as necessary to comply with applicable law.
